Terms of Service

These terms govern your use of the Agrotech Plus website and platform, operated by Agrotech Plus Ltd ("Agrotech Plus", "we", "us"), based in Nairobi, Kenya. By creating an account or using our services, you agree to these terms.

1. Eligibility

You must be at least 18 years old and able to enter a binding agreement to register for an account. By signing up, you confirm the information you provide is accurate and that you meet this requirement.

2. Account types

Agrotech Plus offers three account types:

• Farmer accounts — list produce for sale and receive weather and crop advisories.
• Buyer accounts — source produce from verified farmers. Buyer accounts are reviewed before approval, typically within 24 hours, to maintain marketplace quality.
• Combined accounts — both sell and source produce from a single dashboard.

You are responsible for keeping your login credentials confidential and for all activity under your account.

3. Marketplace conduct

Agrotech Plus connects farmers and buyers; we are not a party to the sale of produce between them. Farmers are responsible for the accuracy of their listings and the quality of produce delivered. Buyers are responsible for honoring agreed prices and payment terms. We may suspend accounts that misrepresent produce, fail to honor agreed transactions, or otherwise abuse the marketplace.

4. Weather and advisory disclaimer

Weather forecasts and crop advisories are provided to support your planning and are based on third-party weather data. They are guidance, not a guarantee of outcomes — Agrotech Plus is not liable for crop losses or decisions made based on an advisory.

5. Solar technology services

Where you engage Agrotech Plus for solar cold storage, irrigation, or drying equipment, the specific commercial terms, pricing, and warranty for that engagement will be set out separately in writing and take precedence over these general terms for that service.

6. Prohibited use

You agree not to use the platform to post false or misleading listings, harass other users, attempt to bypass our bot and fraud protections, or use automated tools to scrape or access the platform without permission.

7. Intellectual property

The Agrotech Plus name, logo, website, and platform content are owned by Agrotech Plus Ltd or its licensors and may not be reproduced without permission. Content you submit, such as produce listings, remains yours, but you grant us the right to display it on the platform to facilitate transactions.

8. Suspension and termination

We may suspend or terminate an account that violates these terms, engages in fraudulent activity, or poses a risk to other users. You may close your account at any time by contacting us.

9. Limitation of liability

Agrotech Plus provides the platform on an "as is" basis. To the extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the platform, including losses related to produce transactions between farmers and buyers.

10. Governing law

These terms are governed by the laws of Kenya. Any dispute arising from these terms will be subject to the jurisdiction of the courts of Kenya.

11. Changes to these terms

We may update these terms from time to time. Continued use of the platform after a change takes effect constitutes acceptance of the revised terms.
